"We were pleased to learn of the vote in the Assembly in favor of the petition No.63/XII/1 'request for reinstatement in the Army of Infantry Captain Arthur Carlos Barros Basto, who was the target of political and religious segregation in 1937' "says a letter today addressed from the League to Assumption Esteves (Speaker of the Assembly).

The story dates back to 1937 when the Army Discipline Board decided to "separate from service" Captain Arthur Carlos Barros Basto, ruling that he did not have the, "capacity for the moral prestige of his function and the decorum  of his uniform."

At issue was the conduct of circumcision operations  to students of the Israel Theological Institute of Porto, which he founded, and the greeting with a kiss of these students, as was the custom of  the Sephardic Jews of Morocco.

Over the years, Barros Basto has been compared by historians to the French General Alfred Dreyfus of Jewish origin who was convicted in 1894, innocently, for high treason.After today’s rehabilitation by  the first (Constitutional)  Commission, now begins the struggle for the second goal of Isabel Lopes, the posthumous reinstatement of Captain Barros Basto in the Army, which will be dealt with by the Committee of National Defense.

For  Rui Silva Leal, the lawyer who accompanied  the process, "Parliament will now know to remove the practical consequence of this rehabilitation of the name of the Captain ", and if,  "today's news is: 'Barros Basto  rehabilitated',  soon it will be 'Barros Basto reinstated ".

Porto, 29 fev (Lusa) – A Liga Anti-Difamação (LAD) transmitiu hoje a sua profunda satisfação pela reabilitação no Parlamento do capitão judeu Barros Basto, afastado do exército em 1937, apelando agora à sua reintegração póstuma em missiva à AR.

“Ficámos satisfeitos ao saber da votação favorável na Assembleia da República da petição No.63/XII/1, ‘Pedido de reintegração no Exército do capitão de Infantaria Arthur Carlos Barros Basto, que foi alvo de segregação político-religiosa no ano de 1937’”, refere carta da Liga hoje endereçada a Assunção Esteves.

A petição, apresentada pela neta do capitão a 31 de outubro de 2011, tinha como fundamento “a violação grave de direitos humanos e a afetação intolerável do núcleo duro dos direitos fundamentais materialmente protegidos pela Constituição da República Portuguesa”, requerendo então a “intervenção da Comissão Parlamentar de Assuntos Constitucionais, Direitos, Liberdades e Garantias”.

“Hoje, a comissão mais importante do parlamento declarou que a sentença de 1937 foi antissemita. Ou seja, Barros Basto não foi imoral; a decisão que o condenou é que foi imoral”, afirmou hoje a neta Isabel Lopes.

A história remonta a 1937 quando o Conselho Superior de Disciplina do Exército decidiu pela "separação do serviço" do capitão Arthur Carlos Barros Basto por considerar que não possuía "capacidade moral para prestígio da sua função e decoro da sua farda".

Em causa estava a realização de operações de circuncisão a alunos do Instituto Teológico Israelitas do Porto, que havia fundado, e a saudação com um beijo dos mesmos alunos, à maneira dos judeus sefarditas de Marrocos.

Ao longo dos anos, Barros Basto tem sido comparado por historiadores ao general francês de origem judaica Alfred Dreyfus que em 1894 foi condenado, inocentemente, por alta traição.

Depois da reabilitação de hoje pela primeira comissão, começa agora a luta pelo segundo objetivo de Isabel Lopes, a reintegração póstuma do capitão Barros Basto no exército, que será tratada pela comissão de Defesa Nacional.

Para Rui Silva Leal, o advogado que acompanhou o processo, “o Parlamento saberá agora retirar a consequência prática desta reabilitação do nome do senhor capitão” e se “a notícia de hoje é: ‘Barros Basto reabilitado’, em breve será ‘Barros Basto reintegrado’”.

Nesse sentido, a própria LAD manifesta a sua “profunda satisfação” para com a “decisão importante” hoje tomada e diz esperar agora pela “muito atrasada” reabilitação do capitão.
